Personal Data and our website

Personal data means any information about a living individual from which that individual can be identified.

Save as set out in our Cookie Policy, Makana Knowledge GmbH does not collect any of your personal data through your visit to or use of the website.  As a result, Makana Knowledge GmbH does not track, fetch, follow, process, share, transfer, store, sell or commercialize any of your personal data through or from the website.

The business model for operating the LUMINLUCID platform is not data-based. Revenues from the operation of the platform are generated purely from the licensing business by contractually regulated fees with corporate customers (B2B) in the form of Unique User ID accesses.

Makana Knowledge GmbH instructs a third party company, Simple Web-Solutions GmbH, to technically host and process the LUMINLUCID® website which is run under Makana Knowledge GmbH. It requires processing website usage data, which potentially constitutes personal data. It does this to enable provision and to optimize the operation of the website. In this arrangement this processing of personal data by the technical host and by the processor is to be qualified as data processing as per Article 28 Regulation (EU) 2016/679 (“GDPR”).

Makana Knowledge GmbH is acting as the operational data processor and Simple Web-Solutions GmbH is acting as the technical data host in relation to your personal data. Processor and technical host will ensure the security of the processing and hosting in accordance with the applicable law and take data security measures to ensure a level of protection appropriate to the risk with regard to the confidentiality, integrity, availability and resilience of the systems.

What information is collected and how it is used

Simple Web-Solutions GmbH (which is engaged by Makana Knowledge GmbH to technically host our website) processes personal data so that our website can operate technically effectively and securely and provide you with the best possible service. The information processed by Simple Web-Solutions GmbH depends on the context of your interactions with our website. It also depends on the choices you make, for example the functions you use and your privacy and security settings within your own systems. You may choose, by those settings, not to provide certain information but if you do, and that information is necessary to provide a particular feature, image, content or media format, then you may not be able to use that feature or view that content. We will only use your personal data where we have a valid lawfully constituted basis to do so and furthermore a contractual duty to fulfill our obligations under the order processing agreement (AVV) according to the DSGVO/GDPR for our B2B clients within the restricted Login Section of the website.

Please note that we may process your personal data without your knowledge or consent in accordance with the above regulations if this is required or permitted by law or where we have a contractual duty to fulfill our obligations under the order processing agreement (AVV) according to the DSGVO/GDPR for our B2B clients within the restricted Login Section of the website.

Sharing your information

You acknowledge that we only process your personal data with your consent or as necessary with the exclusively selected third party service provider, such as Simple Web-Solutions GmbH, and other exclusively selected companies, which are associated with our business, for which you can decide to make contact directly through our website, via a form and only within the login restricted customer section on this website. The provider and associated companies are bound within our collaboration framework that supports us in either the performance of the technical processing activities set out above or to handle your proactive inquiry. We restrict access to your personal data that you have entered in the form and that you submitted to the selected company. The selected company therefore has a business need and access, legitimized by you, to receive and process your personal data at your service. Through our agreements with our exclusively selected companies, each of them is instructed to process your personal data once received and each company is bound to confidentiality.

We require our third party service provider and all other associated companies within our framework to take appropriate and stringent security measures to protect your personal data in line with our policies and the law. We do not allow our third party service provider to use your personal data for their own purposes and only permit them to process your personal data that is transmitted by the filled in form for this specified purpose in accordance with your proactive, dedicated inquiry.

Storing your personal information

For general visitors to our website:

Your personal data will not be stored when you visit and navigate our website. Only if you contact us using the Contact Us form will we receive your explicit data and message you have entered into this form and proactivly submitted to us for the purpose of answering your question.  Your personal data will only be retained for as long as is necessary to fulfill the purposes it was received for and including for the purposes of satisfying any legal, accounting or reporting obligations. Unless we inform you otherwise (or you request that we erase your personal data received from you using the Contact Us form) your personal data received from you using the Contact Us form will be retained for the duration of one year and will then be deleted.

For our B2B clients and their licensed users of LUMINLUCID

We have a contractual duty to fulfill our obligations under the order processing agreement (AVV) according to the DSGVO/GDPR for our B2B clients and their licensed users of LUMINLUCID within the restricted Login Section of the website. This includes the storage of personal data for the purpose of setting up unique named user identifiers (UUIDs), which includes the storage of personal data necessary for this purpose and under the terms of active customer license agreements.

Personal data received, stored and processed for the above purposes are only stored and processed within the European Economic Area. In fact the servers hosting and processing LUMINLUCID data are located in Germany. We ensure your stored and processed personal data receives the level of protection and is treated according with EU laws, particularly  according to DSGVO/GDPR at any time.

Keeping your information secure

The granting of provision to keep your access and personal data on LUMINLUCID until deletion or transfer to a new, separate licensed user account is subject to an agreement between LUMINLUCID and the user ruling the transit period and transfer.
  • Change your data processing preferences at any time.
